PRP Potentially Responsible Party Litigation
Bruce Kingsland & Associates is one of the few investigative firms
in the country with on-staff personnel possessing more than fifteen years
experience conducting large-scale PRP investigations with typical sites
including airports, landfills, former manufacturing facility sites, and race
tracks.
PRP cases commence with an in-depth file review of all relevant client and
EPA documents. A detailed investigative proposal is then presented which
allows for a comprehensive identification of all parties that may have contributed
to a site’s contamination, often over a period of decades.
The investigative process then moves to an extensive inspection of local
and state archived documents, which leads to an historical reconstruction
that identifies all relevant entities that operated within the site’s
proximity including what the entities produced, how, when, where, and what
chemicals may have been used.
Armed with this information, we then identify, locate, and interview former
employees and contractors of the surrounding PRP facilities as well as business
and/or businesses previously located at the site in question and, in the
case of landfills, dump truck drivers and bulldoze operators.
Remaining investigation frequently revolves around identifying current ownership
of liable entities no longer in existence due to mergers and acquisitions
and/or the at the time insurance carrier of a PRP no longer in business.
Over the years, BKA agents have recorded a multitude of “smoking gun” witness
statements from those who directly participated in, or witnessed, disposal
activity…even decades after it occurred.
